1. General terms and conditions

GETON AS is a micro-mobility company that operates with sharing and rental of electric scooters in Norway. The service can only be used by registering via the Geton app which can be downloaded in Google Play or the App Store.

These listed terms & conditions are part of all agreements by GETON AS, a private company incorporated under the laws of Norway, and has its registered office at Jordalsveien 18, 5105 Bergen, Norway with company registration number: 926 117 076.

For your use of these services, Geton requires that You agree to all terms & conditions within this agreement.

You and Geton are the sole parties to this Agreement. You are the sole user of the Services and You must not allow any others to use the Vehicle.

By accepting these terms, You warrant and clarify that You are at least 16 years old. You also warrant that You are physically fit and possess reasonable competence to use and operate any of our vehicles. You also warrant that you possess the necessary capabilities to make competent assessment of the driving conditions to be able to use our services in a responsible manner. This includes considering weather conditions, your health status, and/or any other factors that may be relevant for operating an electric vehicle. You understand that You are solely responsible to adapt speed, breaking and general riding behavior to e.g. (but not limited to) traffic, road state, weather circumstances and similarly to ensure competent and responsible usage.

You also confirm that You shall conduct a basic safety check before using a vehicle, such as inspecting the brakes, wheels, frame, battery level and light for any visible damage or suspect appearance of any kind. You agree to not use the vehicle if any of these factors does not appear satisfactory. If it does not, You agree to report the issue to Geton AS via any of the platforms where you are able to do so, e.g. (but not limited to) the app, the website, or via e-mail.

A Geton Pass is only valid in the city in which it was purchased. Geton AS reserves the right to cancel or change any existing campaign or offer at any time.

  1. Account

To use our services, you must be 16 years of age. and in order to purchase a Geton account you need to download our App on App Store or Google play and must have a valid phone number and valid payment method such as bank card.

Your payment card will be charged NOK 20, – and the amount will be added to your Wallet in the app.

Registration and rental / use of electric scooters is personal. It is not allowed to register / rent an electric scooter on behalf of others.

Price for the service is stated at all times in the application. Geton AS reserves the right to change the price, subscription solution and set restrictions for use at any time.

All accounts and their functionality are subject to approval or discontinuation at our discretion. We reserve the right to reject or terminate any account, temporarily or permanently, and to deny access and prohibit a specific user to use our services.

You are responsible for Your account’s security, including your login identification, password(s) and account details. You confirm that such details are not shared or disclosed with any other party or person. You are responsible for all loss, damage or problems that could arise from disclosing Your account information, as well as any fraudulent activity, digital threat and/or similar scenario. You are required to notify us if You suspect and/or are aware of any activity that seems suspect and/or any unauthorized access of your user account.

  1. Use of our services

As a user of Geton AS’s services, you are obliged to be considerate, cautious so that no danger or injury can occur and so that other traffic is not unnecessarily obstructed or disturbed, cf. section 3 of the Road Traffic Act. the applicable rules of the site at any time and any time period. If you injure yourself or others with the use of an electric scooter, you are personally responsible for any financial loss sustained by us or others.

By using our services, You confirm that any problems that may arise, e.g. not ending the trip successfully in the app, must be reported to us immediately, as it may otherwise be dismissed without further discussion or compensation.

As a user, you are personally responsible for the electric scooter. For example, it is not possible to lend the scooter or rent the scooter on behalf of others. If there is damage to yourself, the scooter or others, while the scooter is lent to someone other than the registered scooter user, you as a registered user are liable on the same line as you should have used the scooter yourself.

You are solely responsible and assume all responsibility and/or risk for any injuries or damages that may arise from using any of our vehicles. You confirm that You will treat any vehicle with common sense care (as outlined in this agreement) and understand that damages, liabilities or costs towards Geton AS arising from You not doing so can result in us demanding full reimbursement from You.

The electric scooters are regularly maintained and checked, but as a user you are obliged to check the condition of the scooter before using it. Before use, always check the wheels, brakes, frame, battery level, or visual damage to the scooter. If damage is detected, you are obliged not to use the scooter. At the same time, you must notify Geton AS of the damage through the Geton application, website or through service personnel on the street. Violation of this obligation to carry out checks and notify in the event of any damage may result in the exclusion and / or liability for financial loss incurred by Geton AS or others.

Registered users are required to wear an approved helmet or other safety equipment if required by local law. Geton AS is not responsible for any damage caused by the failure to use a helmet or other safety equipment.

The user is obliged to follow the speed limits the weather and traffic conditions on site indicate. It is not allowed to be more than one person on the scooter. It is not legal to use the scooter if you are under the influence of alcohol, drugs, medication or other substances that may affect your ability to ride a bicycle safely.

You confirm that You can use the vehicles solely as intended and instructed within our application, in compliance with local regulations, and in compliance with these terms and conditions, such as (but not limited to):

– No altering, dismantling or adjusting being done to the scooters

– Not riding or parking within restricted areas

– Not bringing/riding the scooter outside of the Operational Area (the ‘Operational Area’ is in this case defined as the area where you can end your ride that is surrounded by a red continuous area/fence on the map). Doing this may result in a penalty up to 500,- NOK (in addition to the total cost of the trip).

– If you drive or park our scooters outside our operational zone, you will be held responsible for any loss or damage that may occur to our scooters.

– Not riding more than one person per scooter

– Not riding the vehicle if your total weight (including accessories) exceeds 120kg

– Not sharing/using your Geton Pass or Free Credits for someone else’s benefit, e.g. starting a scooter for someone else (doing this may result in a penalty up to 2000,- NOK and removal of the Geton Pass or Free Credits)

– Billing for unpaid rides: Users are required to provide accurate payment information and maintain sufficient funds or credit to cover the cost of their rides. If a user’s payment is declined, delayed, or not successfully processed for any reason, we reserve the right to send a bill for the unpaid ride to the email address or home address associated with the user’s account and gathered by Geton AS. Unpaid rides will be settled with late fees or penalties of 50kr.

– Report any damages, theft, accident or similar scenario to a vehicle you rented and/or come across

– Using appropriate safety gear

– Not riding in an improper condition, such as (but not limited to): under the influence of substances, distracted, during an unwell physical condition, under the influence of medication or any other factors that may prevent you from operating a vehicle in a responsible and competent way

– Riding properly and competently in regards to all traffic laws and local regulations

– Parking properly in regards to all traffic laws and local regulations

– Not bringing the scooter onto other types of transport (for example, but not limited to: buses, trains, cars, etc)

You confirm that You understand and accept that Any damages and/or costs to Geton AS resulting from not complying with these outlined terms, local traffic laws, and local regulations are subject to be invoiced to You, and are Your sole responsibility unless Geton AS have specifically expressed otherwise in writing.

  1. Disclaimers, limitation of liability & force majeure

You hereby confirm that the usage of our services is solely at Your risk. Geton AS holds no warranties in regards to the service, and no liabilities for events such as (but not limited) to: Errors, interruptions, unavailability, maintenance, state of the vehicles and/or similar.

You confirm and understand that scooters are electric vehicles that may experience issues or malfunctions, even if it has been properly maintained and inspected before use. Such issues may cause injury, damages or dangers of various sorts to You and/or others, people, property or similarly. You confirm that You understand and agree that You are solely responsible for all such dangers and risks that may occur from operating any of these vehicles. When choosing to use our services and operate any of our vehicles You confirm that You assume full responsibility for all related risks and dangers, and that You may be liable for all relating damages, deaths and/or costs. You confirm and understand that operating an electric vehicle involves an element of risk and that dangerous situations can occur and may not be avoidable even if proper precautions have been made.

You confirm that you will indemnify and not make claims or request compensation of any kind against Geton AS relating to the use of our services or operating any of our vehicles. You acknowledge that You have agreed to use our services in accordance to these terms and conditions, and that any use of the services are Your sole responsibility. You agree to not misuse any of our services and failure to do so is Your sole responsibility.

You confirm that Geton AS shall not be responsible for any loss, damage, failure or error which is caused by conditions beyond our control, defined as “force majeure”, such as (but not limited to): natural disasters, change in legislations and/or laws, weather conditions, power breakdown, infrastructure problems, strikes, orders of administrative authorities, interruptive events and/or any events with similar outcome.

  1. Availability

As a registered user of Geton AS electric scooters, you accept that scooters are not available at any time. Geton AS does not guarantee that scooters are available, and as a registered user you also accept that the scooters can be taken out of service for shorter and longer periods due to inclement weather, maintenance, events, season (time of year) or other conditions. Geton AS can also at different events and geographical areas reduce the speed of the scooter in the given area or event. Geton AS is not responsible for any loss, directly or indirectly due to lack of availability.

To use the service, a registered user must be connected to the application service via the Internet. Geton AS is not responsible for the quality and availability of the internet. Registered users are aware that the coverage area may vary and that no guarantee is given that the application is accessible, secure or error-free at all times. Also, there is no guarantee that minor bugs in the application or service will be fixed or under maintenance.

In the event that the Geton application does not register deactivation and termination of the rental period, the user is obliged to contact Geton AS’s customer service immediately. If this is not done, the registered user will be liable for any damage, theft or other financial loss incurred as long as the scooter is registered on it. You also accept that Geton AS can disable the electric scooter at any time.

  1. Accidents, theft and lost scooter

           A registered user who is involved in an accident, collision, injury, personal injury or who experiences the scooter being stolen or lost, is obliged to contact the police immediately (02800 or emergency-112). Furthermore, you are obliged to contact Geton AS’s customer service immediately and report the incident via Geton App, Website or Email. Geton AS is not responsible for giving any wrong information or if the user does not comply with our terms and rules.

  1. Modifications

Geton AS reserves the right to change, update or amend these terms & conditions from time to time without Your consent. You confirm that you on a regular basis should review this agreement to have an up to date awareness in regards to any modifications. You confirm that this agreement supersedes all prior agreements and is the final and complete agreement for using our services. By continuing to use our services, you agree to be bound to these terms and conditions.

  1. Governing law & jurisdiction

You hereby agree that any disputes that arise from using our service or in relation to this agreement will be subject to Norwegian law, and Norwegian courts exclusively. This agreement is governed by Norwegian law exclusively.
